LVI And Its Doctors Are Sued For LASIK Malpractice

On April 23, 2018, Jesus Ruiz filed a complaint against Edward Yee, M.D. and LASIK Vision Institute, LLC, for the negligent performance of LASIK surgery.

On August 22, 2015, Dr. Yee performed LASIK eye surgery on Mr. Ruiz.  According to the complaint, Mr. Ruiz had keratoconus, an ectatic disease that causes progressive thinning and weakening of the cornea, pre-operatively.  The complaint alleges that Dr. Yee failed to recognize pre-operative signs of keratoconus, for which LASIK surgery was contraindicated.  As a result of the elective LASIK surgery, for which Mr. Ruiz was not a suitable candidate, he developed a vision threatening disease known as post-LASIK ectasia.

The complaint further alleges that Dr. Yee  compounded his negligence by failing to offer or recommend the preferred treatment for post-LASIK ectasia, known as collagen cross-linking (“CXL”).  By withholding CXL, Mr. Ruiz progressive cornea disease worsened further.   The complaint contends that Dr. Yee’s negligence in performing contraindicated surgery on Mr. Ruiz rendered him with a permanent visual disability.

Patients with ectasia often suffer a loss of visual acuity.  In addition, individuals may suffer from a host of problems related to the quality of their vision, which include, without limitation, halos, blurry vision, glare, ghosting, starbursts, double vision, light sensitivity, contrast sensitivity, loss of depth perception, difficulty driving a motor vehicle, especially at night, headaches, dry eyes, and foreign body sensation.
