LASIKPlus And Its Doctors Sued For Medical Malpractice
On January 27, 2025, Nicholas Lara (“Mr. Lara”) filed his complaint against Frank Rosenbaum, M.D., Gary Bircham, O.D., LCA-Vision, Inc., d/b/a LASIKPlus, in the Supreme Court of Jefferson County, State of Colorado, for medical malpractice arising from LASIK surgery on June 8, 2023, which was performed at LASIKPlus’ office in Lakewood, Colorado.
The complaint alleges that on June 5, 2023, Mr. Lara, a commercial pilot, came under the care and treatment of the defendants for the purpose of screening for LASIK surgery on both eyes. The complaint alleges that Dr. Rosenbaum allegedly departed from the standard of care by performing LASIK surgery that was contraindicated, and Dr. Birch was negligent in screening and recommending Mr. Lara for a contraindicated LASIK surgery. The complaint further alleges that Mr. Lara’s pre-operative color corneal topographies were abnormal, and revealed clear signs of keratoconus, for which LASIK surgery was and is contraindicated.
As a result of defendants’ medical malpractice and lack of skill, the complaint alleges that Mr. Lara sustained serious permanent personal injuries, including being diagnosed with vision threatening post-LASIK ectasia (progressive thinning of the cornea) in both eyes.
